I really don't know if it is enforceable, but I would think it might be difficult to enforce. Possibly get their IP address blacklisted on spam lists?
I would send the letter anyway, as it won't hurt and may knock some sense into them. Then you should probably just block them on your mail server - or even just using a rule to delete it automatically.
