    trademarked ltd company?

    Hi,

    I'm starting up a website which provides a service to users, but is free to use. My revenue is generated from affiliate schemes and adverts. I'm thinking of going down the Sole Trader route, but am worried that someone else might create a LTD company with my name. Is this possible if I have a trademark for my name? i.e. can someone come up with myCompanyName ltd if I've applied for a trademark of 'myCompanyName'? Also, does it matter which class(es) the trademark was filed in regarding this situation?

    Would be cheaper to just register a company name as Ltd but dont use the company and continue to work as a sole trader?

    Hi,
    Thanks for the quick reply. I hadn't realised I can do this. I thought if you registered a company name as LTD, you had to trade as a LTD company, which means extra paperwork and whatnot. How much does it cost just to register a LTD name but not use it?

    A trademark does not protect a limikted company name so someone else couold snap it if you don't. However new rules now in pace do stop people forming a company name that is too similar to another. So yes, form the company then make it dormant straight away so you only need return one simple form back to CH once a year and £30 or whatever it is nowadays.

    Hi,
    Thanks for the info. I'll consider creating a dormant ltd company for protection. However, thinking about it, if I have to fill in forms for the company anyway, would it not be a good idea to just run under the ltd company? I can't imagine forms being too complicated for a startup website, although I may be wrong?

    Just leave it dormant as running the Ltd gets more involved than doing your own thing ,,

    Ruinning a Ltd Co is expensive and more complex with the accounting and returns to be done every year. Unless you know how to do it, you will have to pay several hundred to an accountant to do it for you. You need professional advice from an accountant to consider of going Ltd is the best option or not.

    That makes sense . Thank you very much for the advice. I'll be sticking to trading as a sole trader for the moment, and have a dormant ltd company for brand protection and possible future use.

    its not necessary to have ltd company... you can start without any company name..
