SMS Marketing

Hi all - wasn't sure of the best place to but this so if its not in the right forum, can a moderator please move to somewhere more relevant.

I'm investigating SMS marketing and must admit I've no idea of the data protection issues - can anyone shed any light on it or point me to a useful resource.

I specifically need to know if I'm allowed to SMS customers on my database when I've never specifically asked for their mobile number for marketing purposes....

Im pretty sure sms falls under TPS, but check the website for the facts as I cant quite remember. If it does, it means you need permission.
