Does anyone know if the usual two year employee rights rule includes constructive dismissal? I know they apply for unfair dismissal but seem to recall that employers can be taken to court for cases of constructive dismissal regardless of whether the employee has been with them for 2 years or not. I could be wrong though so thought I'd ask you wise lot for some advice!
It is a minimum of 12 months employment for constructivre dismissal however, if this has come about because of say, racial or disability discrimination for example, Im sure this can be less than 12m as they are offences in their own right.
Thanks Sandra, hmm now you say it I seem to remember that there are certain circumstances where the 12 month employment rule doesn't apply! Couldn't for the life of me remember before though lol- my head is like a seive lately!
