Default Changes to Grievances and Disciplinary Procedures in 2009

Just had this update from Out-Law.com regarding changes affecting employers and employees in the workplace from April 2009.

The current mandatory 3 step rule will be replaced by a new simplified ACAS code. Take a read here.

No doubt this will be better for some, but I know of one high profile business (locally) that ignored much of the 3 step system even though it is mandatory, so God help when it isnt!

It's a shame that the legal protection for those that need it are being removed and that even more employers will abuse the system than already do

The amount of Tribunal cases has soard since 2004, perhaps doubled if I check the figures, so something hasn't worked. Perhaps it was also too easy to bring a case to tribunal as well. Whatever it is, they're putting the burden back on to the employer and employee to resolve rather than ET judges.

The problem I find is that simply, most people will not speak up and say something to their bosses about a problem when it first happens, then it goes fom bad to worse so that the situation is untenable thus resolving amicably it is not an option.
